Sydney Conveyancing Services

For most of us, buying or selling property or land is one of life’s single largest financial transactions. Moreover, real estate represents one of the most valuable assets you may own. Add to this the complexity of property law, and you have all the makings for a potentially time-consuming, stressful and confusing experience.

If your property transaction is linked to the breakdown or severing of a marriage or de facto relationship, the conveyancing process can become particularly complicated and beholden to Family Law

For all these reasons, it is highly advantageous to seek conveyancing legal advice. Conveyancers are licensed professionals who specialise in property transaction management and counsel. Although a conveyancer does not necessarily need to be a property lawyer, Espino Law provides the best of both worlds - we are exceptional lawyers with outstanding property conveyancing experience.

FAQ

  • Conveyancing is the term used to describe the legal transfer of property ownership from one party to another. A conveyancer specialises in managing the legal and administrative requirements of this process.

  • A conveyancer is crucial in transferring property from one party to another. This is particularly so in New South Wales, where transactions are now electronic and run through the settlement platform PEXA. Appointing an experienced conveyancer or property lawyer can save you time and stress. Although you are not legally obliged to appoint a conveyancer, doing so can save you time, stress and expert knowledge. The role includes running property searches, reviewing contracts, ensuring regulatory compliance and making the transfer process as smooth and efficient as possible.

  • You are not obliged to appoint such a professional before making an offer.. However, consulting with a property conveyancer before purchasing can be very beneficial. By seeking advice, you can potentially avoid problems when the transfer process starts and gain valuable insights.

  • Industry fees vary significantly and can range anywhere from $1,000 to over $2,000. As is always the case in business (and life!) you get what you pay for. When it comes to ensuring your property transaction is compliant, legal and runs as smoothly as possible, you want the best professional on board. Rest assured, Espino Law’s fixed-term rates are extremely reasonable - contact us to find out more.

  • No, they are not the same. Stamp duty is a Government-imposed tax calculated on the value of the property or land. The buyer is responsible for paying stamp duty. In contrast, land transaction refers to the transition of ownership of land from one party to another.
