Complex Family Law Matters Sydney
Family Law is not black and white, and often cases will present that, for any number of reasons, are deemed outside of routine. Equally, a seemingly routine matter might for some reason become complex.
Extenuating circumstances such as domestic violence, a particularly volatile or threatening party, complicated asset structuring, child relocation, relationship complications, gender, and paternity testing may all fall under the area of complex family law.
It is perhaps little surprise that such a situation calls for complex family law specialists who can guide you through the inherent complications and potential challenges.
Regardless of the complexity, Espino Law will always aim for mitigation over litigation to avoid the time, costs and emotional drain of going to Court. Nonetheless, if Court is inevitable, our family matters lawyers ensure you have the most skilful and knowledgeable legal representation.
Our complex family law firm services.
Although able to support and represent you across the broad spectrum of family law matters, we provide three key services within this area of law.
De-facto relationships
The Family Court of Australia views de-facto relationships as no different to married couples. Even so, important nuances such as determining when the relationship commenced and finished can result in complex family law matters arising. For instance, de-facto couples must file a property settlement application within two years of the relationship ending (whereas married couples have 12 months upon finalising their divorce). However, demonstrating when a de-facto relationship ended is not always as clear-cut as knowing when a divorce was finalised.
Same-sex relationships
Family law rules make no distinction between de-facto or legally married heterosexual and same-sex relationships. However, this can become a complicated matter when determining the child’s legal parent/s. You may wish to visit our Complex Family Matters information.
Paternity testing
In Family Law parenting matters, there can sometimes be ambiguity or disagreement around who is a child’s biological parent. The outcome can have profound consequences on Court orders and child custody. As such, it is crucial to determine and resolve this matter.
This typically calls for paternity testing, a process that (with 99.99% accuracy) determines the child’s biological father.
