  • Family Law in Australia is an area of law that deals with family and domestic relationships. The Family Law Act 1975 is the predominant legislation governing matters including marriage and divorce, de facto relationships, property, child custody and support, parenting arrangements, spousal maintenance and family violence.

  • Family Law falls primarily under the Federal government, which is the case here in New South Wales. However, there is one exception: the Family Court of Western Australia is the specialist court in that state.

  • No - Section 121 of the Family Law Act makes it an offence to publicly identify persons involved in Family Law proceedings (including witnesses).

  • No - Family Law focuses on the welfare and well-being of the child. As such, it has no gender or parental role bias.

  • Mediation is a process that can occur either before or after the initiation of legal proceedings. Typically, it is overseen and facilitated by an impartial third party whose role is to promote negotiations and discussions. The objective is for conflicting parties to come to agreements outside of the courtroom.

    Following a successful mediation, any agreement reached (whether pertaining to parenting or property matters) can be formalised through various means, such as a Parenting Plan, an Application for Consent Orders, or a Binding Financial Agreement. In practice, the parties would decide on the formalisation process for the agreement, and the necessary documents would be prepared and, if needed, submitted to the Court following the mediation conference.
